TERMS AND CONDITIONS OF USE
1. WHO WE ARE AND WHAT Blessviva IS
Blessviva is a digital platform operated by Blessbay Corp (“Blessviva,” “we,” “us”), a company incorporated in the State of Florida, United States, with its address at 701 Brickell Avenue 1550, Miami, (33131).
Blessviva is a space where the Spanish-speaking Christian community can buy, sell, connect with professionals, accompany one another, and help one another. The platform brings together four services: a digital community, a product marketplace, a professional directory, and a rewards program for buyers (Blessings).
Blessviva is the plaza where transactions take place. It is not a bank, it does not handle aid funds between individuals, and it does not act as the employer of the sellers or of the professionals who post in the directory.

2. WHO THESE TERMS APPLY TO
These Terms and Conditions apply to every person who accesses or uses the Blessviva platform, including the site www.Blessviva.com, the mobile applications, and any related service.
By using the Platform, registering, clicking “I Agree,” or making a purchase, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Platform.
To use the Platform you must:
– Be at least 18 years old.
– Provide truthful information when you register.
– Accept the Blessviva Code of Ethics, available at Blessviva.com/ethics.
– Not be barred from using the Platform under any applicable law.
3. YOUR ACCOUNT
To access most features you need to create an account with your real name and a valid email address. Fake accounts, duplicate accounts, and impersonation of other people are not allowed.
You are responsible for keeping your password confidential and for everything that happens in your account. If you suspect unauthorized access, notify us at soporte@Blessviva.com.
We may suspend or delete accounts that violate these Terms or the Code of Ethics, or that are used for fraudulent activity.
4. WHAT IS FREE AND WHAT HAS A COST
Blessviva’s rule is simple: everything that unites the community is free. What serves the individual in offering or resolving something has a cost.
4.1 Always free for any registered user
– Taking part in the community: posting on the wall, requesting prayer, replying to others, and joining open channels.
– The daily devotional and the entry-level faith content.
– Buying products in the marketplace. Buying from a brother or sister carries no membership cost.
– Viewing complete profiles in the professional directory: photo, name, city, profession, description, and ratings.
4.2 Requires an active membership
Membership costs US$19.99 per year. With an active membership you can:
– Access professionals’ contact details in the directory (phone, email).
– Publish your own profile in the professional directory.
– Open a seller storefront in the marketplace.
– Access full courses and certificates.
– Redeem Blessings for discounts or contributions to social causes.
– Create your own groups and channels within the community and highlight posts.
5. SUBSCRIPTION — BILLING AND CANCELLATION
The subscription is billed on a recurring basis on the renewal date. By subscribing, you authorize automatic charges to your registered payment method.
You may cancel at any time from your account settings. Cancellation takes effect at the end of the current period; no refunds are given for unused time within that period, except as stated below.
5.1 Subscription refund policy
If you cancel within the first 30 days of your initial subscription, you will receive a full refund. After that period, we will refund 90% of the prorated unused portion if you request cancellation within 12 months after payment.
6. THE MARKETPLACE
6.1 Buying in the marketplace
Any registered user may buy without needing a membership. When you make a purchase, you are making an offer, which is accepted when you receive the confirmation by email.
Prices are in United States dollars (USD) unless expressly stated otherwise. Your payment information is processed by certified third-party providers; Blessviva does not store full card data.
6.2 Selling in the marketplace
To sell you need an active membership and must accept the Seller Agreement, available at Blessviva.com/contrato-vendedor. Each seller is responsible for their products: quality, accurate description, delivery times, and handling of claims.
Blessviva charges a commission on each sale. The current rate is published in the seller dashboard. Blessviva does not buy products from sellers in order to resell them; it acts as the plaza where the transaction takes place.
Blessviva reserves the right to remove products that do not comply with the Code of Ethics, that are illegal or counterfeit, or that generate repeated complaints.
6.3 Marketplace returns
The full Returns Policy is available at Blessviva.com/devoluciones. In summary: you may request a return within 30 days after delivery if the product is defective, damaged, or materially different from its description.
In compliance with the FTC’s Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435): if we cannot ship your order within 30 days after your purchase, we will notify you immediately and you will have the right to cancel and receive a full refund within 7 business days thereafter.
7. THE PROFESSIONAL DIRECTORY — TALENT NETWORK
The directory lets you find and hire professionals from the community: lawyers, accountants, doctors, designers, carpenters, and any trade or profession.
Viewing profiles — photo, name, city, profession, description, and ratings — is free for all registered users. Access to a professional’s contact details requires an active membership.
To publish your profile as a professional you need an active membership and must accept the Talent Network Professional Agreement, available at Blessviva.com/contrato-profesional.
Blessviva does not verify professional degrees or licenses, does not guarantee the quality of any work, and is not a party to the relationship between the professional and the client.
8. BLESSINGS — LOYALTY PROGRAM
Blessings are a rewards program for buyers. They are not money, they are not income, and they have no value outside the Platform.
How they are generated: each purchase in the marketplace generates Blessings in proportion to its value. Subscriptions do not generate Blessings. Blessings are generated per individual purchase, with no chains upward and no additional levels of beneficiaries.
How they are used: members with an active membership may use them as a discount on future purchases within the Platform, or by assigning them to a social cause allied with Blessviva.
Blessings are not transferable, cannot be converted to cash, and do not represent any right to Blessviva’s revenue or assets. Accrual and redemption rates are published in your account dashboard and may be adjusted with 30 days’ notice.
9. AMBASSADORS AND ANGELS
9.1 Ambassadors
Ambassadors are individuals or organizations that have signed an independent Ambassador Agreement with Blessviva. They have a formal commercial role and receive a fee based on the objectives defined in that agreement.
Ambassadors must disclose their commercial relationship with Blessviva in all public content they produce about the Platform.
9.2 Angels
Angels are members of the community who accompany, moderate, and care for those who arrive. Their role is fraternal and voluntary. They receive no financial compensation for inviting new members or for anything done by those they invited.
No Blessviva scheme pays for the act of inviting or recruiting people. Purchasing and active participation in the community are recognized; the number of people brought in never is.
10. HELP AND SOCIAL ACTION
Blessviva makes it possible for the community to help one another and acts with its own resources in social initiatives, under one clear rule: no aid money between individuals passes through Blessviva or through the Platform’s checkout.
When the community mobilizes to support someone, Blessviva makes the case visible and connects people, but the money goes directly between the parties or through a foundation with legal status. Blessviva does not collect or distribute that money.
Blessviva also allocates a percentage of its net profit to allied social foundations. The details of that allocation are verifiable in the company’s operating documents.
11. PROHIBITED CONDUCT
By using the Platform, you agree not to:
– Use the Platform for any unlawful purpose under the laws of the U.S. or any other applicable jurisdiction.
– Create fake accounts, impersonate people, or use the Platform in a way that deceives other members.
– Make promises of income or financial benefits to other people in connection with Blessviva without official documentation to support them.
– Use spiritual, pastoral, or religious authority to pressure people into subscribing, buying, or taking part in any Platform service.
– Harass, intimidate, discriminate against, or treat other members with contempt.
– Post content that is false, defamatory, obscene, or that incites hatred.
– Divert transactions off the Platform to avoid commissions.
– Use automated tools, bots, or scrapers without written authorization.
– Infringe the intellectual property rights of third parties.
Violations may result in suspension or deletion of the account, without prejudice to any applicable legal action.
12. CONTENT POSTED BY USERS
You own the content you post. By posting it on the Platform, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it on the Platform and in promoting it, for as long as your account is active.
You represent that your content does not violate the rights of third parties and complies with these Terms and the Code of Ethics. We reserve the right to remove any content that violates these Terms or the law.
13. INTELLECTUAL PROPERTY
The Blessviva name, logos, the design of the Platform, and all content produced by Blessviva are protected by U.S. intellectual property laws. You may not use them without written authorization.
We grant you a limited, personal, non-transferable license to use the Platform for personal, non-commercial purposes.
13.1 DMCA notice
If you believe that content posted on the Platform infringes your copyright, send a notice to our DMCA Agent:
Email: legal@Blessviva.com
The notice must include: identification of the copyrighted work, identification of the infringing material and its location on the Site, your contact information, a good-faith statement that the use is not authorized, and your signature.
14. PRIVACY
The handling of your personal data is governed by our Privacy Policy, available at Blessviva.com/privacy. By using the Platform, you accept the practices described in that policy.
15. ELECTRONIC COMMUNICATIONS
By registering your account, you agree to receive communications from Blessviva by email and through in-Platform notifications. You may unsubscribe from marketing messages at any time by clicking the unsubscribe link in any email or by writing to privacy@Blessviva.com.
16. THIRD-PARTY SERVICES AND PLATFORMS
The Platform operates on third-party infrastructure, including payment processors and technology providers. Your use of those services is subject to their own terms. Blessviva is not responsible for the acts or omissions of those providers.
17. NO WARRANTIES
The Platform is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or freedom from errors.
18. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Blessviva and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
Our total liability to you will not exceed the greater of: (a) the amount you paid to Blessviva in the 12 months before your claim, or (b) US$100.00.
19. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Blessviva and its officers, employees, and agents from any claim, damage, cost, or expense arising from: (a) your use of the Platform; (b) the content you post; (c) your violation of these Terms; (d) promises of income or representations about Blessviva that you make without authorization; or (e) your violation of the rights of third parties.
20. RESOLUTION OF CONFLICTS BETWEEN MEMBERS
When a conflict arises between members of the community, the process is as follows:
– First: a direct, private conversation between the parties.
– Second: if it is not resolved, either party may request mediation through legal@Blessviva.com.
– Third: if mediation does not resolve the conflict either, or if the offense is serious from the outset — fraud, harassment, exploitation of religious authority for financial purposes — the case goes to the Ethics Committee, whose decisions are final within the community.
21. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. For any claim that is not subject to arbitration under Section 22, you agree to the exclusive jurisdiction of the courts of [Miami-Dade County], Florida.
22. BINDING ARBITRATION AND CLASS ACTION WAIVER
Read this section carefully. It affects your legal rights.
22.1 Arbitration agreement
Except for the exceptions set out in Section 22.4, you and Blessviva agree that any dispute arising out of these Terms or the use of the Platform will be resolved through binding individual arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect, available at www.adr.org.
22.2 Process
The arbitration will take place in Miami, Florida, or remotely if Blessviva so elects. The arbitrator’s decision is final and may be enforced in any court of competent jurisdiction.
22.3 Class action waiver
You and Blessviva both waive the right to take part in a class or representative action. You may bring claims only on an individual basis. If this waiver is declared unenforceable, the arbitration agreement will be void as to that claim and it will be resolved in court.
22.4 Exceptions to arbitration
Either party may go to court to seek urgent injunctive relief. Claims that qualify for small claims court may be filed there. Claims for sexual harassment or sexual assault are excluded from mandatory arbitration under U.S. federal law.
23. CHANGES TO THESE TERMS
We may update these Terms. When changes are material, we will notify you at least 30 days in advance by email or through a notice on the Platform. If you continue to use the Platform after the changes take effect, we understand that you accept them.
24. GENERAL PROVISIONS
Entire agreement. These Terms, together with the Privacy Policy, the Code of Ethics, and the applicable specific agreements, constitute the entire agreement between you and Blessviva.
Severability. If any provision is declared invalid by a court, the rest of the Terms remains in force.
No waiver. Blessviva’s failure to enforce a provision at a given time does not mean it waives the right to enforce it in the future.
Assignment. You may not assign your rights under these Terms without Blessviva’s written authorization.
Language. In the event of a discrepancy between the Spanish version and the English version, the English version prevails.
